Like every employee, you have rights

As a Ministry of Defence employee, you have the same rights as everyone else who isn't employed by the Army, Navy or Royal Air Force.

This means you're entitled to a safe working environment and reasonable precautions to keep you safe from harm.

While we know that being part of the military has its dangers and that harm in direct combat sometimes can't be avoided, you should have received the correct safety equipment and training to help to keep you as safe as possible in the situations you're likely to face.

Health and Safety at Work Act 1978

Every employee is protected by the Health and Safety at Work Act 1978, which is a collection of laws that are there to keep you safe at work. The Health and Safety at Work Act requires certain things from your employer, including:

  • Providing the correct training information for you to be able to carry out your role
  • Making sure any environment they control is safe for you to work in and doesn't pose risks to your health
  • Maintaining equipment
  • Making sure there are no risks to your health when handling, storing or transporting work goods.

The Armed Forces Compensation Scheme (AFCS) is a scheme created by the government to allow access to compensation for people who have suffered illness, injury or death as a result of military service.

The scheme allows injured service men and women and their loved ones to access a tariff based system for compensation if their accident happened on or after 6 April 2005.

Claiming through the AFCS is not a civil claim, like the one you can make with us, so you apply for this type of compensation separately.
