What is ATE insurance?
After the event (ATE) insurance covers the legal costs if your claim isn't successful, and is used alongside no win no fee to take the financial risk out of making a claim.
Your insurance will cover:
- Any costs your solicitor has had to pay while making your claim, such as reports, further investigation, and court fees
- The other party's legal costs, which you'd normally need to pay if your claim isn't successful
You won't need to worry about buying insurance when you claim with us. Our solicitors will arrange it on your behalf before starting your claim, and you won't need to pay any upfront fees.
You can read more about ATE insurance below, or you can get in touch with us for free, impartial advice on , or via our call back form. We're happy to answer your questions in a confidential, pressure-free environment and can let you know whether you we think you could claim.
ATE insurance and no win no fee
ATE insurance is used with no win no fee to avoid you being left out of pocket if your claim is unsuccessful.
Quite simply, no win no fee means that if you don't receive your compensation, then your solicitor won't charge you for their service. You can read more about no win no fee.
ATE insurance adds a layer of protection on top of our no win no fee agreement. It means, if your claim is unsuccessful the insurance will cover the other side's costs, and any expenses your solicitor had to pay when they were building your case.
Also, you'll only need to pay for the insurance if your claim is successful. So, you don't need to worry about being left with an insurance bill to pay out of your savings.
There are a small number of cases where it's not possible to make your claim on a no win no fee basis. If this applies to you, your solicitor will let you know before starting your claim and will be able to talk through your options.
How much does it cost?
The cost of ATE insurance depends on how likely you are to win your claim. The amount it costs can change as your case continues, depending on the time and risk of the claim.
If you don't receive any compensation for your injury, then you won't have to pay anything for your ATE insurance - it'll be paid for by your solicitor as part of your no win no fee agreement.
If your claim is successful, you'll pay for the insurance out of your compensation as part of the fees.
How do you purchase ATE insurance?
Your insurance is purchased by your solicitor after your accident (after the event), but before they get in touch with the other party to start your claim. This means you'll be protected from having to pay extra costs right from the start. It's not possible to get ATE insurance without having an appointed solicitor.
