Debunking personal injury compensation claim myths
Whilst we have, for almost 30 years, helped thousands claim for their personal injuries, many people are still put-off getting the compensation they deserve because of several myths they may have heard about and believed in.
This is why we've written our guide to false claims about making a claim, to debunk some of the most commonly believed myths and hopefully help more people get their lives back on track when they've been injured in an accident that wasn't their fault.
Breaking the stigma...
In our research, almost half of people believed in the common stigmas attached to making a claim. We're making it our aim to remove these stigmas and ensure people get what they deserve.
Myth: Making a claim is too complicated
Many people don't make a personal injury claim as they believe that it requires too much time, effort and stress and therefore isn't worthwhile. Well, if you're one of those people, you'll likely be relieved to hear that this simply isn't the case.
If and when you're ready to make a claim, a call with one of National Accident Helpline's friendly, expert advisors is all it takes to get things started. Your story will be listened to and you'll be given impartial advice about whether you can make a claim, with no pressure to proceed.
Choose to proceed with a claim and we'll put you in touch with a highly-experienced solicitor who'll do all they can to get you the compensation you deserve.
As part of the process, you may be required to provide some details and evidence of your accident, and you'll be put in touch with a medical expert to understand your injuries and how they've affected you. This will help build your case.
Beyond this however, most of the hard work and legal processes will be taken care of for you. It is as simple as that.
Myth: Making a claim takes too long
There isn't a ‘one size fits all' approach to compensation claims, when it comes to the time they take.
How long it takes to complete your claim, and get you your compensation, can depend on factors such as the complexity of your accident and claim, the amount of compensation and how cooperative the other side is.
When making a claim with National Accident Helpline, you can be assured that your specialist solicitor will not only be taking care of most of the work for you, but also ensuring that your claim is handled as quickly and efficiently as possible.
And, once you accept an offer of settlement for your claim, your compensation could reach you within 14-28 days of settlement.
Myth: Making a claim is expensive
The ‘cost' of making a personal injury claim is one of the most common reasons why some people won't make a claim, believing that they'll only end up losing most of their compensation to cover the costs of the process anyway.
Claim with National Accident Helpline and the costs of doing so will be clear and simple.
Your claim will be on a no win no fee basis, as confirmed when you enter the contract between you and your personal injury lawyer, meaning you'll only be expected to pay any costs or expenses if you win your claim.
These costs would likely include a ‘success fee' to compensate your solicitor for their time and expertise and any other expenses not covered by the other side, and will only be deducted when your compensation is paid.
However, even with these fees to cover, you can be assured that you'd receive the majority of your compensation, as we believe that it is what you deserve, and what you need to help get life back on track.
Myth: I have to go to court for my claim
If you're worried about making a personal injury claim as you believe you'll have to go to court, you'll probably be interested (and relieved) to hear that court hearings for compensation claims are rare.
More than 95% of compensation claims we take care of are settled without having to go to court. And even in rare cases that require a court visit, our specialist solicitors offer guidance and support throughout the process, to make it as easy and stress-free as possible.
Myth: People will think i'm just 'in it for the money'
The term ‘claims culture', and its connotations, is one that many people in the UK are familiar with. Some judge those who make a compensation claim, suggesting that it is just an easy way to make money for nothing.
This simply isn't true.
If someone makes a claim and is successful in doing so, they would have been deemed entitled to compensation for the injuries received in an accident that wasn't their fault.
They will have completed the claims process, having provided evidence and supporting medical reports along the way. And, of course, they'd have likely suffered physically, emotionally and been affected financially as a result of their accident.
So, in fact, that ‘money for nothing' is actually vitally important compensation for helping those who have suffered and taken action to put things right.
Myth: I will be sacked if I claim for an accident at work
Accidents at work are unfortunately quite common, and in a lot of cases such accidents are of no fault to the person who may have been harmed.
However, the belief that making a compensation claim for an accident at work will lead to prejudice in the workplace, or even the person involved being sacked, is quite common too.
If you're one of the people who believe this to be the case, you can take it from us that an employer cannot sack someone for making an accident at work claim. It is illegal to do so.
So if you're involved in an accident at work, and it wasn't your fault, you can make a claim knowing you've this peace of mind.
Myth: My Medical Negligence claim will harm the NHS
We're all aware of the pressure on the NHS and its staff. We hear about the problems that hospitals and GPs across the country are facing every day on news bulletins, in newspapers and from those who work in our health service.
For some who have suffered from Medical Negligence in the care of the NHS, this is enough to prevent them from making a compensation claim, believing that it would cost an already under-pressure hospital or surgery directly if they did so.
However, medical negligence claims brought against the NHS are actually handled by the NHS Resolution. Created by the government, this acts like insurance for all NHS Trusts, with money - covered by annual premiums paid by NHS Trusts - set aside for any claims made against them.
This means that, if you do unfortunately suffer from Medical Negligence, you can make a claim in confidence knowing that getting the compensation you deserve is already accounted for.
