It is vital when you make a personal injury claim that you provide as much evidence of your accident and injuries as possible. In this case, you need to prove that the injury was not your fault but that of the negligent other party. One key type of evidence is to get witness statements so details of witnesses, and what they saw, are a must. 

Other victims involved

When you make a compensation claim for an accident that was not your fault, there may be other victims involved in the accident. Also, you may not be the only person with an injury who decides to make a compensation claim. As part of your compensation claim, the fact that other victims are making a claim against the same party as you can be really helpful.

The person(s) at fault (the other side)

When you make a personal injury claim you do so as you believe the other party was at fault. However, it is not always entirely clear who the person at fault on the other side is. For example, if you were injured as a result of a slip on spillage on a ship floor,  you may need to decide if it is the owner or the cleaner of the shop who is at fault.  Alternatively, if your injury was a result of a product defect it is likely the product manufacturer is at fault but it could instead be that something happened which the retailer you purchased from is responsible.

Whoever the claim is made against, it will likely be their insurers who pick up the claim as the other party. The main thing is that liability is admitted by the other side so that compensation can be negotiated with your solicitor.
